Skatepark contract gains council nod

    After additional terms were added by the city attorney, council members approved a contract with the potential builder for an Imperial skatepark.
    Action approving the contract with Pillar Design/Artisan Skateparks, headquartered in North Carolina, came at Monday’s city council meeting.
    At meeting time Monday, the changes added by City Attorney Josh Wendell had not yet been reviewed by the company’s owner, said City Administrator Jo Leyland.
    She said she put in on Monday’s council agenda for approval so design work can start immediately should the company okay the changes.
    Otherwise, any start on the project would have to wait until after the council’s January meeting, Leyland said.    
    If there are some revisions the company doesn’t agree with, the contract will again be reviewed, she said.
    Wendell told council members it is not a standard contract. Rather than getting a bid on the project ahead of time, the company is using the “design-build” concept, which provides a turnkey design and construction plan within a targeted dollar amount.
    That amount is $147,600. The company will have to stay within that figure for all of its design and construction costs, according to the contract.
    The skatepark original project total was $150,000 but was reduced in the Artisan contract because $2,400 was used for a soil compaction test at the potential site in Campbell Park.
    One of the revisions added by Wendell was the chance to withdraw from the contract after the design phase is complete and all the construction documents are received at a city cost of no more than $10,000.  That provision allows the city not to proceed with construction if they choose not to for some reason, he said.
    Also added by the city attorney were terms on the project deadline and liquidated damages. Artisan’s work is required to be finished by June 30, 2018. A $100 penalty will be assessed each calendar day after if not completed.
