Stipulations in place for Blackshirt Feeders’ conditional use permit

The list of stipulations attached to Blackshirt Feeders conditional use permit has been released by the Dundy County Clerk’s office.
Dundy County Commissioners Scott Olson, Richard Bartholomew and Jerry Fries approved the CUP following a public hearing June 6.
After approving the CUP, the commissioners reviewed a list of stipulations suggested by consultant Keith Marvin and forwarded to the commissioners by the Dundy County Zoning and Planning Board following a Feb. 1 hearing and  meeting.
Top of the list is approval for the proposed 100,000-head feedlot from the Nebraska Department of Environment and Energy. The feedlot would sit just south of the Dundy/Chase County line.
With setback distances contingent on the facility remaining aerobic according to NDEE, the facility may not change to anaerobic without the setbacks being re-examined.
Blackshirt Feeders must have a fly and dust mitigation plan in place.
Marvin had suggested road maintenance plans be in place with Chase County and Dundy County before construction began. The commissioners agreed that they cannot govern another county and removed Chase County from the stipulation while leaving the requirement of a plan with Dundy County.
Plans for the state-of-the-art facility call for roller compacted concrete pens and roads. The commissioners included the stipulation that the facility will not be converted to a standard feedlot with dirt pens without modifying the CUP and having a new public hearing
No dead animals shall be composted on the property
All water runoff and liquid waste shall be contained on site as proposed and all grades shall be such to create positive drainage from parts of the facility
The original list of stipulations included proposing that Blackshirt Feeders provide Dundy County an annual report regarding capacity and issues addressed during the proceeding year and the requirement to forward all complaints received to Dundy County for review, plus meetings between the facility manager and the county following complaints.
The commissioners amended this to an annual report, and forwarding all complaints to Dundy County for review. Discussion included Blackshirt Feeders sending its state and federal reports to the county, as well.
Also required is the Upper Republican Natural Resource District board approval of the feedlot’s water requirements and accessibility.
New to the stipulations is the requirement that Blackshirt Feeders pay the defense deductible for NIRMA’s representation of the county if litigation should arise in regards to the CUP
Removed from the stipulations were no liquid effluent to frozen land and notifying adjacent properties 24 hours before application of liquids or manure.
